Another defeat for the Qualcomm in the dispute that the company has with Apple in several courts around the world.
Recently, as we reported, she lost an important battle by failing to ban the import of iPhones into the U.S. as she still wanted Apple to be accused of infringing an invention by Qualcomm, the judge of the United States International Trade Commission (U.S. International Trade Commission, or ITC) denied the request, saying that factors of public interest weighed against the granting of Qualcomm's request.
Now, in one of the many processes that are taking place in Germany, a panel with three judges decided that the iPhones 7 and 7 Plus do not violate Qualcomm's European patent (EP1199750). Such decision was taken one week after the start of the trial which, according to the FOSS Patents, suggests a difficult path for a possible appeal by Qualcomm to the Munich High Regional Court.
This is just one of several cases that are ongoing in Germany. In addition to this, we have one to be tried on November 8 and another that is due for December, this is only in Munich; there is also one in the city of Mannheim.
Apple sued Qualcomm for the first time in January 2017. Since then, the two companies have been battling in court in several courts around the world. Although several side fights have already arisen, the main reason for the imbalance revolves around Ma's discontent with Qualcomm's alleged abuse for demanding high royalties for their technologies.
