IPhones 4s users sue Apple over iOS 9 performance on devices

Whenever a new version of iOS is released, some users of older iPhones complain that Apple has slowed its devices on purpose, to force the purchase of a newer model. The discussion is old and, just as there are examples that everything is even slower, there are others proving that the difference is almost imperceptible.


However, with other users (more than 100 in total), Chaim Lerman did not want to hear about it and decided to sue Apple. The collective action basically says that Ma made misleading advertising by disclosing that iOS 9 is compatible with old devices, such as iPhones 4s. Their complaint that iOS significantly interferes with the performance of the 4s and, as Apple does not allow downgrade for older versions of the operating system, they are forced to choose between an “inoperable device” (slow to open apps, unresponsive touchscreen at various times, freezes, etc.) or spending hundreds of dollars on a new device.

Even though Apple has conducted internal tests and everything, Lerman says the company was well aware of the negative impact of iOS 9 on the iPhone 4s features. Despite that, Ma went on to promote the performance of the operating system as faster, safer, offering longer battery life and other attractive features without alerting owners of older hardware (specifically owners of iPhones 4s) about these possible problems compatibility.

Because of all this, the collective action is seeking damages of $ 5 million with an option that could triple that amount.

The proof that history always repeats itself is here: a lawsuit opened in 2010 by an iPhone 3G user who was dissatisfied with the performance of iOS 4. We will see what this will bring.
