French piracy law goes on vacation without definitive yes

A new version of the text is ready, which will become French legislation against piracy in the coming months. The Law of the Three Warnings, as it became known, has given rise to a kind of soap opera, full of advances and setbacks and much controversy.

The government proposal envisaged that users who repeatedly repeat copyright infringement practices in their online experience would be temporarily disconnected from the Internet. During this period they would have to continue to pay the Internet service monthly fee.

According to the initial proposal, the monitoring of law enforcement would be in charge of a body created for this purpose, Hapodi, which would have the power to decide to cut the Internet without the intervention of the courts. After vetoed and in a second approved reading, the legislation did not pass through the courts, with the French constitutional council considering that there was a violation of French laws in this deposit of powers to Hadopi.

The Sarkozy government, which has already guaranteed that it intends to take the process to an end and make every effort to bring new legislation into force in this area quickly, has presented a new document that complies with the judicial decision, passing on to this area the power of decide whether or not the user can be deprived of Internet access.

The nuance is the fact that the new text provides for a «fast and effective treatment» of these processes and for the sake of that objective eliminates the need for pre-sentence hearings, as reported by El Mundo.

Criticisms of different aspects of the process are already being felt and a new vote is also scheduled for next July.
