The fine imposed by the communications regulator on Portugal Telecom was confirmed by the Lisbon Court of Appeal, which decided to keep the decision of the sectoral body and a fine of 50 thousand euros applied at the time.
The fine refers to the failure by PT Comunicações to comply with all the necessary procedures to disconnect customers from the pre-selection service. The infringements took place between July and October 2006 and gave rise to an administrative offense, which blamed the company for having acted only on the basis of knowledge of requests addressed to the unselected provider.
As Anacom had already considered, the court also argues that the law obliges the company that provides direct service to act only if it becomes aware of the request via the pre-selection service provider.
PT’s first judicial appeal was filed by PT, which appealed the fine to the Lisbon Commercial Court. This instance proved him right and annulled the fine. Anacom’s appeal now changes the direction of the decision.
