Vodafone and TMN lost the first «round» in court against Anacom’s decision to set different interconnection prices for Optimus.
The two operators had advanced in August with precautionary measures so that Anacom’s decision on asymmetry in termination rates was suspended, but the Court decided to dismiss these processes, reports Jornal de Negócios.
Vodafone and TMN will now be able to appeal the decision or wait for the main underlying actions to be determined, which, in the end, may lead to a claim for compensation for damages caused if the Court decides in favor of the operators, instead of suspending the decision.
The precautionary measure brought by Vodafone was the first to be decided and the judge dismissed it. The same decision was taken in the analysis of TMN’s request.
