In 2012 the VirnetX won one to Apple's court in the amount of $ 368 million. However, that result was contested and a new trial started based on the same infractions, with an initial order from VirnetX in the $ 532 million range.
Now, after a week of deliberation, the Texan jury (the state known for defending the rights of patent owners) has come to the conclusion that Apple has indeed infringed VirnetX's inventions. The total amount that Apple must pay, however, is greater than what is required: US $ 625.6 million (US $ 334.9 million for infringing patents 6,502,135 and 7,490,151 related to VPN on iOS 3 to 6; US $ 290.7 million for infringing patents 7,418,504 and 7,921,211 related to iMessage / FaceTime technologies used in iOS 4 to 6 and OS X 10.7 to 10.8).
Apple made the following statement about the case: “We are surprised and disappointed with the verdict. Cases like this simply reinforce the desperate need for patent reform. ” The company also filed a court order to set aside the trial, claiming that VirnetX's lawyers cheated the jury during the final arguments it is not known when Judge Robert Schroeder will rule on the request.
J Jason Cassady, a lawyer at VirnetX, said: "The jury saw what we have been saying for a long time: Apple has been infringing on VirnetX patented technologies for years."
Apparently, the dispute is still far from over.
