Apple loses resource and will have to pay $ 440 million to VirnetX

THE Apple and the security company VirnetX they are heading for the ninth year of their (not fruitful) relationship in the courts. In part, the imbroglio between the two companies continues due to the number of accusations and lawsuits in progress – so much so that a 2016 court decision, which Apple appealed, only came out this week.

More precisely, Apple lost an appeal he opened after an American court ruled in October 2016 that the company should pay VirnetX $ 302.4 million for patent infringement. At the time, that judgment overturned another court decision, in which VirnetX could receive an even greater amount: $ 625.6 million.

Even with the slightly smaller fine, the Cupertino giant appealed the decision; the US Federal Court of Appeals has now voted the appeal in favor of VirnetX and the original fine has gone up to $ 439.7 million due to an additional voluntary infraction – in addition to interest, attorney fees and other costs.

It is worth noting that the patents used in the case were invalidated by the Patent and Trademark Office (Patent and Trademark Office), but VirnetX is still resorting to this determination, as Reuters. Apple said in a statement that it is «disappointed with the decision» and that it also plans to appeal (again).

As we said, this patent war has already been going on for nine years. In general, such inventions are related to VPN networks and FaceTime, which is possibly one of the reasons why this Apple service was never available on other platforms.
